Inference Service Terms

During the BETA phase of the Inference Service, additions to the Terms of Service, Service Level Agreement, and Privacy Policy apply.

Amendments to the Terms of Service

In addition to the Terms of Service at https://www.genesiscloud.com/legal/terms-of-service the following terms apply:

Section 1 – Definitions

Add the following definition:

v) “Inference Service” means the optional, BETA-stage functionality offered by Genesis Cloud that enables users to send prompts to and receive outputs from hosted machine learning models for the purpose of executing inference tasks, such as natural language processing or image generation.

Section 2 – Provision of Services

Add a new sub-section (h):

h) Inference Service (BETA). Genesis Cloud may make available, a BETA version of its Inference Service.

  • The Inference Service is provided “as-is” and “as available” with no guarantees regarding uptime, performance, model availability, or result accuracy.
  • Genesis Cloud may change, suspend, or discontinue the Inference Service (or any models offered as part of it) at any time without notice.
  • Customer is solely responsible for evaluating the suitability of the Inference Service for its intended use.

Section 10: Warranty

Add the following clause (e) under Warranty:

e) BETA Services. Any services explicitly designated as BETA, including the Inference Service, are experimental and provided without warranties of any kind. Genesis Cloud disclaims any and all liability arising from the Customer’s use of BETA services and shall not be liable for any instability, unavailability, or loss arising from such use.

Amendments to the Service Level Agreement

In addition to the Service Level Agreement at https://www.genesiscloud.com/legal/service-level-agreement the following terms apply:

Amendment to Section 1.1 – Covered Service

Current Text:

This means all paid Services offered by Genesis Cloud, such as dedicated server hosting, managed Kubernetes as well as rendering, machine learning, and transcoding Services.

Amended Text:

This means all paid Services offered by Genesis Cloud, such as dedicated server hosting, managed Kubernetes, rendering, machine learning, and transcoding Services, excluding Services designated as BETA, including the Inference Service, unless otherwise stated in specific Documentation or an applicable Order Form.

New Subsection in Section 4 – SLA Exclusions

Add the following bullet under Section 4:

(e) the Inference Service, which is currently offered as a BETA feature-flagged service, and as such, is explicitly excluded from any uptime commitments or Financial Credit eligibility under this SLA.

Amendments to the Privacy Policy

In addition to the Privacy Policy at https://www.genesiscloud.com/legal/privacy-policy the following terms apply:

3.3. Use of the Inference Service (BETA)

The legal basis for the processing of your personal data (if any) in the context of using the Inference Service is Art. 6 (1) lit. b GDPR (performance of a contract) or Art. 6 (1) lit. f GDPR (legitimate interests), where our interest lies in providing a technically functional and reliable machine learning inference feature to our customers.

Purpose

The Inference Service enables users to submit data (e.g., prompts, queries) and receive machine-generated responses from hosted models. This service is intended to support machine learning-based inference use cases such as text generation, classification, or summarization.

Data handling

Genesis Cloud does not store any Customer prompts or generated outputs when using the Inference Service. The data is processed only transiently in-memory to fulfill the immediate request and is not retained in logs or databases. Genesis Cloud does not use such data for model training, product improvement, resale, or any form of analytics.

No processing of personal data by design

The Inference Service is not designed to process personal data. Users are advised not to submit any personal data in their prompts or content inputs. If personal data is submitted despite this notice, Genesis Cloud will process such data only to the extent required to provide the service and immediately discard it afterward, without further storage or reuse.

Duration of storage

No prompts or outputs are stored. Data is only temporarily held in volatile memory during request execution and then discarded.
